1. About these terms

These terms apply when you use guidingnorthhr.co.uk. The website is operated by Derek Carter, sole trader, trading as Guiding North HR from 58 St James's Gardens, Penicuik, Midlothian, EH26 9DU. You can contact Derek at derek@gnhr.co.uk.

By using the website, you agree to these terms. If you do not agree, please stop using it.

2. Website information is general

The website explains Guiding North HR's experience, approach and services. Its content is general information and is not tailored HR, employment law, legal, financial or other professional advice for your particular circumstances.

Employment and workplace decisions can carry significant legal and practical consequences. You should obtain advice based on the relevant facts and current law before acting.

3. No client relationship through website use

Visiting the website, sending an enquiry or arranging an initial conversation does not by itself create a client relationship or place Derek under a duty to act. Work begins only when scope, fees, responsibilities and applicable terms have been agreed in writing.

Client services are governed by separate engagement terms. These website terms are not a contract for HR consultancy services.

4. Accuracy and availability

Derek takes reasonable care to keep website information useful and current, but does not promise that every item will always be complete, accurate, error-free or available. Law, guidance, services and prices may change. Content may be updated, suspended or removed without notice.

5. Acceptable use

You must not:

  • use the website unlawfully, fraudulently or to harm another person;
  • attempt to gain unauthorised access to the website, server or connected systems;
  • introduce malware, malicious code or disruptive material;
  • scrape, copy or reuse substantial website content without permission;
  • impersonate another person or provide deliberately misleading information; or
  • send confidential employee information, passwords or security credentials through the initial enquiry form.

6. Intellectual property

Unless stated otherwise, the website content, wording, brand assets, service descriptions, frameworks and downloadable materials are owned by or licensed to Derek Carter trading as Guiding North HR. You may view and print a reasonable copy for your own internal, non-commercial reference. You may not reproduce, sell, adapt, publish or commercially exploit the content without written permission. Third-party trade marks and content remain the property of their respective owners.

The website may link to or embed services operated by other organisations, including Google Maps, YouTube, Calendly, social platforms or a chat provider. These services have their own terms and privacy practices. Links are provided for convenience and do not amount to an endorsement or guarantee of third-party content.

8. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any rights that cannot legally be excluded. Subject to that, Derek is not responsible for loss caused by reliance on general website information instead of obtaining advice for the specific circumstances, for third-party websites or services, or for events outside his reasonable control. Where the law permits, liability for business loss arising only from use of the public website is excluded, including loss of profit, revenue, opportunity, goodwill or anticipated savings and indirect or consequential loss.

Use of personal information and website technologies is explained in the Privacy Notice and Cookie Policy. Those documents form part of the website's transparency information but are not contractual promises beyond what the law requires.

10. Changes to these terms

These terms may be updated to reflect changes in the website, services or law. The effective date at the top shows when they were last revised. Continued use after an update means the revised terms apply from that point.

11. Scottish law

These terms and any non-contractual dispute arising from website use are governed by the law of Scotland. The Scottish courts will have jurisdiction, subject to any mandatory rights that apply to you as a consumer.
